Terms and Conditions of the ELC Solicitors Referral Scheme
The Scheme
- The Referral Scheme (“the Scheme”) is available to businesses, corporate entities and individuals, subject to acceptance by ELC Solicitors (“the Firm”).
- All members of the Scheme must be 18 years and over.
- A ‘Referral’ is the online introduction of a client to the Firm or one of its associated businesses once the client has been given a quotation by you and the client has agreed with you that he/she will proceed with the Firm or one of its associated businesses.
- Passing of leads will not qualify as a Referral.
- The Scheme is personal to you. Neither the Scheme nor any benefits that flow from the Scheme is transferable to any other person.
- The Scheme access details must not be given to anyone else. For security reasons it must not be disclosed to any person.
- Participation in the Scheme is strictly subject to these Terms and Conditions. By participating in this scheme, you agree to be bound by these Terms and Conditions.
- The Firm reserves the right to amend or terminate the Scheme, or these Terms and Conditions at its sole discretion at any time, with or without notice and the changes will be posted on the website.
- The Firm’s employees and their family members are not permitted to participate in the Scheme.
Participation in the Scheme
- All participants in the Scheme must only refer clients via the online system via www.elcsolicitors.com. Referral fees are borne by the Firm and are treated as part of its marketing costs.
- The Scheme member must notify the Firm of change of his/her personal details. The Firm is not responsible for delayed or undelivered mails of the members of the Scheme.
- The referral fee will be paid by cheque, on completion of the particular referred case/s. The Firm shall not be liable for delay or failure to perform any obligation under these Terms & Conditions if the delay or failure is caused by any circumstances beyond its reasonable control, including, but not limited to, acts of god, war, civil disorder or industrial dispute.
- The Firm can take any action it considers appropriate if it has any reason to believe that you are abusing the Scheme, including withholding payment and or removal from further participation in the Scheme.
- The Scheme cannot be used in conjunction with any other offer from time to time being introduced or promoted by the Firm.
Rules pertaining to the introduction of new clients
- Cold calling the general public is strictly prohibited and you must not approach any person you do not have a previous relationship with to promote ELC Solicitors or any associated business of ELC Solicitors. The Law Society and the Solicitors Regulation Authority has strict rules concerning contact with the general public and as such this will be considered a serious breach of these Terms and Conditions.
- You must not advertise the services of the Firm without the prior written consent of one of the Partners of ELC Solicitors. The Law Society and the Solicitors Regulation Authority have strict rules concerning advertising of legal services and hence a breach of this clause will be considered a serious breach of these Terms and Conditions
- The participants of the scheme agree to strictly comply with the Solicitors’ Code of Conduct 2007 and any other laws, rules or code of conduct, which may be imposed by the Solicitors’ Regulation Authority, the Law Society or any other regulatory body, pertaining to the conduct of Solicitors.
- We are required by the Solicitors Regulation Authority to declare to clients all referral fees, commission and introduction fees.
- ELC Solicitors are prohibited from working with any organisation that obtains clients through means that would be contrary to the Solicitors’ Code of Conduct 2007.
- These rules are policed by the Firm and we are required to evidence the fact that we have taken steps to ensure that all referrers are complying with the Solicitors’ Code of Conduct 2007. In the event that we discover a breach of these Terms and Conditions or any of the rules, laws, regulations or principles referred to herein, the Firm reserves the right to request evidence to show that there was no breach. The Firm further reserves the right to refuse to make payment under the Scheme.
- You must, before you introduce a client, disclose the fact that you are getting a referral fee to the client. The newly introduced client will at the outset be informed in writing of all referral fees payable.
- Any advice provided by the Firm to its clients is independent, confidential and impartial.
The Scheme is not available retrospectively. It will only be effective, if an instruction is received via our online introducer section. You will be provided a login and password on registration.
- The Firm reserves the right to refuse to act for a party.
- These Terms and Conditions do not affect your statutory rights
